This Privacy Policy explains how OVER FRACHT LLC (“OVERFRACHT,” “we,” “us,” or “our”) collects, uses, discloses, retains, and protects information in connection with the iQLoader software platform, website, mobile-accessible services, applications, and related services (collectively, the “Services”).

By accessing or using iQLoader, you acknowledge the practices described in this Privacy Policy.

This Privacy Policy applies to information collected through iQLoader and related websites and services. It does not apply to third-party websites, applications, or services that we do not control.

1. INFORMATION WE COLLECT

Depending on how you interact with iQLoader, we may collect the following categories of information.

A. Account and Identification Information

We may collect:

name;
email address;
telephone number;
username;
password or authentication credentials;
account ID;
company name;
job title or role;
carrier or fleet information;
billing contact information.

B. Subscription and Transaction Information

When you purchase a subscription, we may collect or receive:

subscription plan;
billing status;
transaction history;
payment date;
payment method type;
last four digits or tokenized payment information;
billing address;
tax-related information.

Payment information may be processed directly by our third-party payment processor. OVERFRACHT generally does not need to receive or store complete payment card numbers when payment processing is handled by such provider.

C. Vehicle, Load, and Equipment Information

To provide iQLoader functionality, we may collect and process operational data including:

VINs;
year, make, model, trim, and body type;
vehicle dimensions and weight information;
vehicle position on a car hauler;
truck and trailer selections;
equipment configurations;
platform positions;
axle configurations;
loading sequence;
pickup and delivery information voluntarily entered by the user;
calculated axle loads;
calculated loaded height;
calculated total length;
load plans and configuration history.

Vehicle, load, and equipment information may constitute Personal Information only to the extent that it identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household.

Information concerning the physical or technical characteristics of trucks, trailers, car haulers, platforms, hydraulic components, equipment, or other machinery — including geometry, dimensions, measurements, clearances, platform ranges, axle configurations, equipment capabilities, and similar technical specifications — is not treated by OVERFRACHT as Personal Information where such information relates to the equipment itself and cannot reasonably be linked to an identifiable individual or household.

Information generated through the loading, positioning, configuration, measurement, simulation, optimization, operation, evaluation, or testing of equipment may also be treated as non-personal operational or technical information when it does not identify or reasonably relate to an individual or household.

D. Device and Technical Information

We may automatically collect:

IP address;
browser type;
operating system;
device type;
device identifiers;
application version;
login time;
pages or features used;
referring URLs;
crash reports;
diagnostic logs;
network information;
security and authentication events.

E. Location Information

We may infer approximate location from IP address.

If future iQLoader features use device location, routing, clearance, or location-based functionality, and you enable those features, we may process location information as necessary to provide the requested functionality.

We will request permission where required before accessing precise device location.

F. Usage and Analytics Information

We may collect information about how iQLoader is used, including:

features accessed;
session duration;
interaction with load plans;
optimization requests;
configuration changes;
device and browser information;
error and performance data;
referral information.

We may use this information to operate, secure, analyze, and improve iQLoader.

G. Communications

If you contact us, we may retain:

H. Equipment, Technical, and Operational Data

In connection with the operation, development, testing, and improvement of iQLoader, we may collect or generate technical and operational information relating to vehicles, trucks, trailers, car haulers, equipment, platforms, and loading configurations, including:

equipment geometry;
dimensions and measurements;
platform dimensions and operating ranges;
axle locations and configurations;
clearances;
equipment specifications;
loading positions;
platform positions;
combinations of vehicles and equipment;
loading and unloading configurations;
fit and clearance results;
optimization results;
simulation results;
testing results;
equipment performance information;
configuration patterns;
calculated or observed relationships between vehicles and equipment;
other technical, statistical, or operational information generated through use, loading, testing, simulation, or evaluation of equipment.

To the extent such information does not identify, relate to, or reasonably link to a particular individual or household, it constitutes Non-Personal Equipment and Operational Data for purposes of this Policy.

OVERFRACHT may separate, aggregate, anonymize, or de-identify operational information from account, customer, driver, dispatcher, carrier, or other identifying information.

2. SOURCES OF INFORMATION

We may obtain information:

directly from you;
from your employer, carrier, fleet, dispatcher, or account administrator;
automatically from your device;
from payment and technology service providers;
from vehicle-data or VIN-data providers;
from integrations that you authorize;
from publicly available or licensed commercial data sources;
from other users within your organization who are authorized to provide information to iQLoader.

3. HOW WE USE INFORMATION

We may use information to:

create and manage accounts;
authenticate users;
provide iQLoader functionality;
generate and save load configurations;
identify vehicles using VIN or other vehicle information;
calculate estimated dimensions, weights, heights, lengths, and configurations;
provide optimization and decision-support functionality;
synchronize information between devices;
provide offline functionality and subsequent synchronization;
process subscriptions and payments;
manage users and car-hauler access;
provide customer support;
communicate service-related information;
prevent fraud and unauthorized access;
detect technical or security problems;
maintain and improve iQLoader;
develop new functionality;
analyze aggregated product usage;
comply with applicable laws;
enforce our Terms of Service;
protect our users, OVERFRACHT, and third parties;
establish, exercise, or defend legal claims;
develop, validate, test, improve, and refine equipment models and geometry;
analyze vehicle-to-equipment fit and loading configurations;
improve loading, positioning, measurement, simulation, and optimization methodologies;
create technical, operational, statistical, aggregated, and de-identified datasets;
develop benchmarking, equipment intelligence, industry analytics, models, algorithms, and future products or services.

We may create aggregated, statistical, anonymized, or de-identified information from information collected through the Services, including information relating to equipment, vehicle characteristics, loading configurations, measurements, simulations, optimization results, and testing.

To the extent such information cannot reasonably identify, relate to, or be linked to a particular individual or household, OVERFRACHT may use it for any lawful business purpose, including analytics, research, benchmarking, product development, equipment modeling, algorithm development, artificial intelligence or machine-learning development where legally permitted, performance analysis, industry intelligence, development of commercial datasets, and improvement of iQLoader and other products or services.

4. HOW WE DISCLOSE INFORMATION

We may disclose information to the following categories of recipients.

Service Providers

We may use vendors providing:

cloud hosting;
data storage;
cybersecurity;
authentication;
payment processing;
email delivery;
customer support;
application monitoring;
analytics;
database services;
VIN and vehicle data;
software development and infrastructure.

These providers may process information only as necessary to provide services to us and subject to contractual restrictions where required.

Your Organization

If your account is provided or managed by a carrier, company, dispatcher, fleet operator, or other organization, authorized administrators of that organization may have access to account and operational information associated with their organization.

Authorized Integrations

If you authorize iQLoader to connect with a third-party service, transportation management system, dispatch platform, load board, or other integration, we may exchange information with that service as necessary to perform the integration.

Equipment, Technical, Aggregated, and De-Identified Data

OVERFRACHT may disclose, provide, license, distribute, commercialize, or otherwise make available Non-Personal Equipment and Operational Data, as well as aggregated, anonymized, or de-identified information, to third parties for lawful business purposes.

Such recipients may include, for example:

equipment manufacturers;
truck and trailer manufacturers;
vehicle manufacturers;
transportation and logistics companies;
technology providers;
software developers;
research organizations;
data and analytics companies;
insurance or risk-management organizations;
industry participants;
business partners.

Such information may include equipment specifications, geometry, measurements, operating ranges, loading configurations, aggregated fit results, testing results, optimization patterns, performance statistics, and other technical or operational information, provided that information treated as de-identified or non-personal is not reasonably capable of identifying a particular individual or household.

Legal and Safety Reasons

We may disclose information if reasonably necessary to:

comply with law, subpoena, court order, or lawful government request;
enforce agreements;
investigate fraud or security incidents;
protect the rights, property, or safety of OVERFRACHT, users, or others;
establish, exercise, or defend legal claims.

Business Transfers

Information may be transferred in connection with a merger, acquisition, financing, restructuring, sale of assets, bankruptcy, or similar business transaction.

5. SALE OR SHARING OF PERSONAL INFORMATION; COMMERCIAL USE OF NON-PERSONAL DATA

OVERFRACHT does not sell Personal Information for monetary consideration except where expressly disclosed and permitted under applicable law.

For clarity, the sale, license, disclosure, transfer, commercialization, or other use of Non-Personal Equipment and Operational Data, aggregated information, statistical information, or properly de-identified information is not treated by OVERFRACHT as a sale of Personal Information where such information is outside the applicable legal definition of Personal Information.

OVERFRACHT may use, disclose, license, distribute, commercialize, or sell such non-personal, aggregated, statistical, or de-identified information for lawful purposes, including:

equipment and vehicle research;
equipment design and development;
benchmarking;
transportation analytics;
logistics analytics;
product development;
software and algorithm development;
industry intelligence;
commercial datasets;
partnerships with equipment manufacturers, carriers, technology providers, and other industry participants.

OVERFRACHT will not intentionally include information identifying an individual user, driver, dispatcher, or other natural person in a commercial dataset represented as de-identified or non-personal information.

6. USE OF NON-PERSONAL EQUIPMENT AND OPERATIONAL DATA

Subject to applicable law, information generated through the use of iQLoader that does not constitute Personal Information — including equipment geometry, technical measurements, equipment specifications, loading configurations, platform positions, simulation results, optimization results, testing results, performance information, and aggregated or de-identified operational data — may be retained and used by OVERFRACHT for its lawful business purposes.

Such purposes may include:

operating and improving iQLoader;
creating or improving truck, trailer, car-hauler, vehicle, and equipment models;
improving optimization algorithms;
research and development;
statistical analysis;
benchmarking;
creation of technical or commercial databases;
development of new products and services;
artificial intelligence and machine-learning development where permitted by law;
licensing;
commercialization;
disclosure to business partners;
sale or other commercial distribution.

To the extent permitted by applicable law, users do not obtain ownership rights in OVERFRACHT's aggregated, statistical, derived, or de-identified datasets merely because information generated through their use of the Services contributed to those datasets.

7. COOKIES AND TRACKING TECHNOLOGIES

iQLoader and its website may use cookies, local storage, software development kits, pixels, and similar technologies.

Strictly Necessary Technologies

These may be required for:

login;
authentication;
security;
session management;
subscription functionality;
preferences;
core website operation.

These technologies generally cannot be disabled without affecting functionality.

Functional Technologies

These technologies may remember preferences and improve usability.

Analytics Technologies

We may use analytics providers to understand usage, performance, and technical issues.

Examples may include analytics platforms such as Google Analytics or comparable providers, if enabled.

Advertising Technologies

We may use advertising or conversion-measurement technologies such as Meta Pixel, LinkedIn Insight Tag, Google advertising technologies, or similar tools if enabled.

Where required, non-essential advertising or tracking technologies will be subject to consent or privacy-choice mechanisms.

Users may manage available preferences through our cookie or privacy settings.

8. DO NOT TRACK AND GLOBAL PRIVACY CONTROL

Some browsers provide a legacy “Do Not Track” signal. Because there is no uniform industry standard governing such signals, we may not respond to traditional Do Not Track signals.

Where applicable law requires recognition of an opt-out preference signal, such as Global Privacy Control (GPC), we will process a valid signal as required by law.

9. DATA RETENTION

We retain information only for as long as reasonably necessary for the purposes described in this Policy, subject to legal, accounting, operational, security, dispute-resolution, and enforcement requirements.

Our general retention targets are:

Account and profile information: duration of the account and generally up to 3 years after account closure.

Load, VIN, equipment, and configuration information: duration of the account and generally up to 3 years after termination or deletion, unless a longer period is reasonably necessary for legal, operational, fraud-prevention, or dispute purposes.

Subscription, billing, consent, and transaction records: generally up to 7 years.

Terms acceptance and subscription authorization records: generally at least 7 years or such longer period as required to demonstrate legal compliance.

Customer support communications: generally up to 3 years after resolution.

Security and system logs: generally up to 24 months, subject to security needs.

Analytics information: generally up to 26 months unless aggregated or de-identified.

Marketing records: until you unsubscribe or until no longer needed, with limited suppression information retained as necessary to honor your opt-out.

Backups: deleted information may remain in secure backup systems for a limited period, generally up to approximately 90 days, unless technically or legally necessary for longer.

We may retain particular information for longer if necessary to comply with law, resolve disputes, investigate misuse, collect fees, enforce agreements, or establish or defend legal claims.

Non-Personal Equipment and Operational Data; aggregated and de-identified information: may be retained for an indefinite period where the information no longer constitutes Personal Information and continued retention is permitted by applicable law.

OVERFRACHT may retain equipment geometry, technical specifications, derived measurements, testing results, statistical models, aggregated configuration information, and other non-personal technical or operational information for product development, historical analysis, benchmarking, research, commercialization, and other lawful business purposes.

10. DATA SECURITY

We use reasonable administrative, organizational, technical, and physical safeguards designed to protect information against unauthorized access, loss, misuse, alteration, and disclosure.

No internet transmission, storage system, mobile device, or database can be guaranteed to be completely secure. Accordingly, we cannot guarantee absolute security.

You are responsible for maintaining the confidentiality of your account credentials and securing devices used to access iQLoader.

11. CALIFORNIA PRIVACY RIGHTS

California's Consumer Privacy Act, as amended (“CCPA”), applies only to businesses meeting statutory criteria.

California privacy rights described in this Section apply to Personal Information as defined by applicable law. They generally do not apply in the same manner to information that has been properly de-identified, aggregated, or otherwise falls outside the statutory definition of Personal Information.

To the extent OVERFRACHT is subject to the CCPA with respect to your personal information, California residents may have the following rights, subject to exceptions provided by law.

Right to Know / Access

You may request information about categories and specific pieces of personal information we have collected and certain information about our collection, use, and disclosure practices.

Right to Delete

You may request deletion of personal information, subject to legal exceptions.

Right to Correct

You may request correction of inaccurate personal information.

Right to Opt Out of Sale or Sharing

Where applicable, you may direct us not to sell or share personal information for cross-context behavioral advertising.

Right to Limit Use of Sensitive Personal Information

Where applicable, you may request limitations on uses of sensitive personal information beyond purposes permitted by law.

Right to Non-Discrimination

We will not unlawfully discriminate against you for exercising applicable privacy rights.

Authorized Agents

Where permitted by law, an authorized agent may submit a request on your behalf. We may require verification of the agent's authority and your identity.

Where applicable, we will process such requests in accordance with the law governing the request.

13. SENSITIVE PERSONAL INFORMATION

Certain information, such as account credentials, financial account information combined with access credentials, and precise geolocation, may be considered sensitive personal information under applicable law.

We use sensitive personal information only as reasonably necessary to provide, secure, administer, and improve the Services or as otherwise permitted by law, unless we provide additional notice and choice where required.

Equipment geometry, trailer dimensions, platform measurements, axle locations, equipment operating ranges, loading configurations, and similar technical information relating solely to machinery or equipment are not treated by OVERFRACHT as Sensitive Personal Information merely because they are collected or generated through use of iQLoader.

iQLoader is a commercial transportation and logistics product and is not intended for use by children.

Users must be at least 18 years old or the age of legal majority in their jurisdiction.

14. OFFLINE DATA

Certain iQLoader functionality may operate offline.

Information generated or stored while offline may remain locally on the user's device and may later synchronize with our systems when connectivity becomes available.

Users are responsible for controlling access to devices on which offline iQLoader information is stored.

15. THIRD-PARTY SERVICES

Our Services may link to or integrate with third-party services.

Third parties operate under their own privacy policies and terms. OVERFRACHT is not responsible for the privacy practices, security, or content of third-party services.

16. INTERNATIONAL PROCESSING

iQLoader is operated from the United States.

Information may be processed or stored in the United States or other countries in which our service providers operate. Those jurisdictions may have data-protection laws different from those of your location.

Where required, we will use appropriate legal mechanisms for international transfers.

17. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time.

The “Last Updated” date will indicate the most recent revision.

Where required by law, we will provide additional notice before material changes become effective.
